Terms of Use

GENERAL AGREEMENT.

Zev Vitaly Abosh – PhotoArt4U will commit to make every effort possible to fulfill the Photography Services associated with the photo-session/wedding. If Photographer cannot perform photo-session/wedding and his commitment in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Studio will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event of photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agree that an entirewedding cannot be replicated, reenacted or repeated for the purpose of a reshoot and limits Studio's liability to the amount paid under this contract. Any other sessions can be reshoot again and will be, in case of incidents mentioned above.

WEDDINGS - It is understood and agreed that no other professional photographer/studio will be allowed to photograph or take pictures (during the wedding day) while the present Studio’s Photographer/s is/are working.

On signing of the agreement by both parties hereto, the Studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, the reservation fees are non-refundable even if the date is changed (or if the photo-session/wedding becomes cancelled by the clients for any reason).

RETAINER - A non-refundable retainer fee of 50% (or minimum of $1500 for weddings) is due at the signing of the agreement, with a further payment of all necessary expenses (unless otherwise specified) such as development, travel, hotel charges, etc. The remaining balance is due 2 weeks prior the photo-session/wedding day.

No photography will take place and no rights are granted until timely payment is made in full. Any already paid fee is non-refundable in case of cancellation or date change by the client.

TIME FRAMES AFTER THE PHOTO-SESSION/WEDDING:
- Turnaround time for delivery of the digital images may depend on the season and other projects we're involved with. Average time is within 2-3 WEEKS for photo-sessions and 2-3 MONTHS for weddings.
- Turnaround time for delivery of any albums ordered with/through us will be 10-15 business days, from the day you APPROVE the design.
